As the Chief Prosecutor in the Office of General Counsel you will serve as a special assistant attorney general for prosecution of the Department's criminal fraud matters. The attorney, with minimal oversight by the Chief Legal Counsel, shall evaluate matters referred for prosecution, guide and assist with investigations to develop cases for indictment, properly advance the case through the judicial system, seek just resolution, and manage their caseload to include providing relevant updates to the Chief Legal Counsel. These prosecutions range from single perpetrator fraud to complex schemes involving many defendants to defraud the State of South Carolina and its taxpayers. May handle other matters as assigned by the Chief Legal Counsel.

Key Responsibilities

The Chief Prosecutor will:

  • Evaluate referrals from the agency’s integrity unit for potential prosecution on matters related to Unemployment Insurance (UI) benefits fraud and UI tax fraud.
  • Seek indictments of selected targets suspected of committing UI benefit and UI tax fraud.
  • Advance and manage cases through the judicial system appropriately and timely.
  • Negotiate and discuss cases with defense counsel seeking to obtain a just resolution to each case.

Minimum and Additional Requirements

Education and Experience

A Juris Doctor Degree and a member in good standing with the South Carolina Bar are required.

Additional Requirements

Must satisfy Rule 403 requirements. Organized and able to work independently with minimal supervision; Possess excellent written and oral advocacy skills; Possess significant experience the Court of General Sessions. Some travel may be required.

Preferred Qualifications

Preference for experience practicing in the Court of General Sessions or equivalent Criminal Prosecution/Defense.
