Overview
To provide support and assistance during the entire contract lifecycle, from initiation through execution and closeout, by coordinating and performing administrative activities related to contract management and adhering to procedures and regulatory requirements to ensure compliance of all Nesma & Partners' contracts to best protect the organization's interests, supporting the achievement of business objectives while minimizing potential risks and disputes.
Responsibilities
- Provide administrative support throughout the entire contract lifecycle, from inception to closeout, to ensure that the organization's contractual activities are effectively managed, legally compliant, and effectively executed, while also minimizing risks and contributing to efficient project execution.
- Adhere to procedures for contract management and administration to enhance legal compliance and risk management, ultimately contributing to successful contract execution and organizational success.
- Prepare and draft comprehensive contract documents, incorporating technical specifications, scope of work, terms, and conditions to ensure a clear, comprehensive, and well-informed perspective on the project's requirements and potential challenges.
- Archive all contracts-related documentation to establish an organized, accessible, and secure system for storing and managing contract records throughout their lifecycle.
- Provide support to the negotiation process by sharing contract insights to contribute valuable technical expertise and considerations, ensuring that contract terms, conditions, and specifications align with the project's requirements, as well as achieving agreements that are legally sound and technically viable.
- Perform the administration of procurement contracts, from inception to close out, including extensions, updating, cancellations, and other related activities with contractors, suppliers, and service providers to ensure that processed contracts align with the standard contract terms and conditions.
Contracts Administration
- Revise contract terms, conditions, and technical specifications to ensure accuracy, clarity, and alignment with project objectives and Nesma & Partners' policies, contributing to the optimization of contractual agreements.
- Participate in the maintenance of a robust system for tracking contract deliverables, milestones, and deadlines, ensuring timely execution and performance.
- Maintain accurate and organized contract records, documentation, and correspondence to support reference, auditing, and reporting purposes.
- Facilitate the proper closeout of contracts from an administrative perspective to ensure a well-organized, transparent, and satisfactory conclusion to the contract's lifecycle, leading to successful project outcomes, stakeholder satisfaction, and the establishment of a foundation for future contractual engagements.
- Track contract compliance throughout project execution and provide status updates to the Contracts Manager to ensure that all parties fulfill their contractual obligations.
- Contribute to addressing and resolving contractual disputes, conflicts, or discrepancies that may arise during project implementation by collaborating with relevant stakeholders to ensure effective resolution.
- Analyze contract data, trends, and performance metrics to provide insights to identify areas for process optimization and contribute to continuous improvement efforts.
- Stay informed about industry trends, legal developments, and regulatory changes that could impact contract management practices to ensure that the organization's contract management processes remain up-to-date, effective, and compliant with the evolving landscape.
Collaborative and Risk Management
- Participate in identifying potential risks and challenges within contracts and collaborate with stakeholders to proactively assess, manage, and mitigate risks to ensure successful contract execution and project outcomes within Nesma & Partners.
Stakeholder Collaboration and Communication
- Foster positive relationships with stakeholders to address their concerns, provide administrative support, and ensure that contractual expectations are met.
- Participate in the collaboration and communication with cross-functional teams, legal experts, technical specialists, and project managers to ensure seamless contract management and coordination throughout the contract lifecycle.
- Follow all relevant Contracts & Legal processes, policies, standard operating procedures, and instructions so that work is carried out in a controlled and consistent manner.
- Demonstrate compliance with the organization's values and ethics at all times to support the establishment of a value-driven culture within the organization.
Quality, Health, Safety & Environment (QHSE) Management
- Conduct all activities in a safe and environmentally responsible manner in compliance with internal policies and guidelines.
Reporting
- Assist in the preparation of timely and accurate reports to meet Contracts & Legal requirements, policies, and quality standards.
Qualifications
- Education/Certification: Bachelors in Engineering, Construction Management, or any other related field.
- Experience: 0 - 4 years' related experience in roles within similar positions.
- Languages:
- Skills: Contract Drafting & Development, Contract Law, Contract Analytics, Legal Documents Control, Regulatory Compliance, Risk Management.
Technical Preferred
- Education/Certification: Masters in Business Administration, Law (LLM), Engineering, Construction Management, or any other related field.
- Certification: Certified Construction Contract Administrator (CCCA), Contract Management, or similar certifications.
- Experience: Experience in the EPC industry
