Position Summary

We are seeking an experienced Plaintiff-Side Consumer Protection Litigation Attorney with a strong background in FDCPA and FCRA litigation to handle cases from intake through resolution. This role is ideal for an attorney who understands contingency-fee litigation, is comfortable taking ownership of files, and wants to grow within a plaintiff-focused practice.

The position involves hands-on litigation, client advocacy, motion practice, discovery, settlement negotiation, and, where appropriate, trial work.

Key Responsibilities

Litigation & Case Handling

• Handle a caseload of FDCPA and FCRA matters on the plaintiff side
• Draft and file complaints in NY state courts and federal courts nationwide
• Manage all phases of litigation, including:
• Motion practice
• Discovery (written discovery, depositions)
• Settlement negotiations
• Court conferences and hearings
• Appear in court (remote and in-person, as required)
• Work cases independently while collaborating with firm leadership on strategy

Client Advocacy & Case Development

Evaluate potential FDCPA/FCRA claims and liability theories

• Communicate with clients regarding case status and strategy
• Identify violations, damages, statutory penalties, and fee recovery opportunities
• Assist in developing firmwide litigation strategies and templates

Practice Growth & Strategy

• Contribute to expanding the consumer protection docket
• Help refine intake standards and case-selection criteria
• Stay current on FDCPA, FCRA, CFPB regulations, and relevant case law
• Mentor junior attorneys or staff as the practice grows (if senior)

Required Qualifications

• Licensed attorney in New York (additional jurisdictions a plus)
• Plaintiff-side FDCPA and/or FCRA litigation experience required
• Strong federal court experience preferred
• Proven ability to manage cases independently
• Excellent legal writing and oral advocacy skills
• Comfortable working in a contingency-fee practice environment
• Strong ethical standards and client-focused mindset

Preferred Qualifications

• 3+ years of FDCPA/FCRA litigation experience
• Experience litigating in SDNY / EDNY and other federal districts
• Trial or evidentiary hearing experience
• Familiarity with related statutes (TCPA, NY GBL §349, state consumer laws)
• Experience handling cases nationwide

Compensation Structure (Contingency-Based)

This is a plaintiff-side, performance-driven role.. Compensation may include:

• Competitive base salary (commensurate with experience)
• Percentage of fees recovered on cases handled
• Performance bonuses tied to settlements, judgments, and fee awards
• Opportunity for increased percentage or partnership track based on results

High performers are rewarded. There is no artificial cap on upside.
