SUMMARY

The Federal Employment Law Attorney provides contractor support to the Department of Labor (DOL), delivering expert-level legal services in federal sector labor relations. The position performs advanced labor relations litigation work, serves as agency representative in grievance arbitrations, and provides strategic advisory support to agency leadership on matters involving federal labor-management relations.

The role requires demonstrated expertise in the application and interpretation of the Federal Service Labor-Management Relations Statute (5 U.S.C. Chapter 71), extensive arbitration litigation experience, and the ability to present cases before third-party adjudicatory forums including arbitrators and the Federal Labor Relations Authority (FLRA).


DUTIES

Federal Labor Relations Litigation

  • Serve as agency representative or counsel in federal labor relations arbitrations.
  • Develop case strategy for grievance arbitrations, including legal analysis and risk assessment.
  • Prepare and examine witnesses, including conducting direct and cross-examinations.
  • Manage evidentiary submissions and hearing documentation.
  • Draft and submit post-hearing briefs and arbitration exceptions.
  • Represent the agency before the Federal Labor Relations Authority (FLRA), as applicable.

Statutory & Regulatory Application

  • Apply and interpret the Federal Service Labor-Management Relations Statute (5 U.S.C. Chapter 71).
  • Analyze and apply FLRA decisions, regulatory guidance, and related federal labor precedents.
  • Address MSPB interactions where applicable in cases with overlapping jurisdiction.
  • Ensure compliance with federal labor statutes, regulatory frameworks, and agency policy.

Collective Bargaining & Agreement Interpretation

  • Interpret and apply Collective Bargaining Agreements (CBAs), Memoranda of Understanding (MOUs), and related labor-management agreements.
  • Provide expert-level advisory support on negotiated agreement provisions and management rights.
  • Assess labor contract obligations and advise leadership on defensible courses of action.
  • Support dispute resolution efforts and settlement negotiations.

Legal Research, Analysis & Writing

  • Conduct advanced legal research on complex federal labor relations matters.
  • Draft arbitration briefs, legal memoranda, settlement agreements, and formal written advisories.
  • Prepare persuasive written arguments for submission to arbitrators and the FLRA.
  • Develop legally sound documentation suitable for audit or appellate review.

Strategic Advisory Support

  • Provide strategic labor-relations advice to agency leadership and HR professionals.
  • Assess litigation risk and recommend mitigation strategies.
  • Support proactive labor-management engagement and compliance initiatives.
  • Advise senior officials on high-visibility or sensitive labor matters.

EDUCATION

  • Juris Doctor (JD) from an accredited law school.
  • Active bar membership in good standing.


REQUIRED QUALIFICATIONS

  • Licensed Employment Law Attorney in good standing in at least one U.S. jurisdiction.
  • Ten (10) or more years of experience practicing federal employment or labor law.
  • Demonstrated expertise in federal sector labor relations, including application of 5 U.S.C. Chapter 71.
  • Extensive experience serving as agency representative or counsel in grievance arbitrations.
  • Proven success handling arbitration case strategy, witness preparation, evidentiary presentation, and post-hearing briefing.
  • Strong oral advocacy skills, including examination and cross-examination of witnesses.
  • Exceptional legal research, analytical, and writing skills.


PREFERRED QUALIFICATIONS

  • Experience supporting the Department of Labor or another large federal civilian agency.
  • Experience filing or defending arbitration exceptions before the FLRA.
  • Experience advising executive-level or SES leadership.
  • Experience negotiating labor settlements or alternative dispute resolutions.
