The Office of Enforcement (OE) at the Department of Managed Health Care (Department) handles the litigation needs of the Department, representing the Department in actions to enforce the managed health care laws of California. The OE has an exciting opportunity for a motivated person committed to providing their best work product as part of a legal team. A Legal Analyst is a journey analytical and paralegal classification and the successful candidate will be responsible for providing legal analysis and support commensurate with a journey level of experience. The successful candidate will work both independently and as part of a legal team on sensitive and complex cases for the Department related to prosecuting those entities found to have violated the Knox-Keene Health Care Service Plan Act of 1975, (Health and Safety Code section 1340, et seq.) and its implementing regulations (California Code of Regulations, title 28, division 1, chapter 1 (sections 1300.41-1300.826)).
ESSENTIAL FUNCTIONS OF THIS POSITION INCLUDE, BUT ARE NOT LIMITED TO, THE FOLLOWING (other duties may be assigned):
Under the general supervision of an attorney who shall accept full responsibility for the tasks performed, and the direction of the Staff Services Manager I, the incumbent will be assigned to the Division of Legal Administration’s Legal Services Branch. The Legal Analyst (LAN) will perform difficult and complex legal work consisting of managing their own caseload investigating, analyzing, drafting operative documents, and prosecuting procedural violations with oversight and guidance by the Chief Counsel and Assistant Chief Counsel. In addition, the LAN will provide journey-level legal support to assigned attorneys in the investigation and prosecution of the attorneys’ cases. The LAN will draft correspondence and operative documents on their own caseload and assist an attorney with drafting and proofreading their operative documents; assist attorneys with drafting, summarizing, and responding to discovery; and maintain electronic and physical case files. The LAN will assist with trial preparation by preparing hearing notices, processing civil and administrative subpoenas, communicating with third parties and the court, and reviewing evidence; assist in administrative proceedings by preparing drafts of accusations and statements of issues. The LAN will interact with courts, administrative agencies, governmental entities as directed by the OE staff to ensure deadlines are met; and serve legal pleadings in multiple jurisdictions, including state, federal and appellate courts, or the Office of Administrative Hearings. The LAN performs other duties as required.
