Litigation
- Handling litigations for the Company in various Courts/Forums including Labour Courts, Industrial Courts,
- Small cause courts, Magistrate Court, District and Session Courts, High Courts etc PAN India.
- Handling Arbitration proceedings and proceedings before the High Court arising out of such Arbitrations,
- briefing and assisting the external Counsels in the ongoing Arbitration proceedings.
- Drafting statement of claim, interim applications, statement of defense, affidavit in reply, evidence affidavit, rejoinder, surrejoinder, counter claims.
- Drafting reply to legal notices, regulatory notices, active/inactive employees, third party association or
- Labour union representations etc.
- Assessment and evaluation of risk arising out of pending litigation cases.
- General advisory to internal / external stakeholders on ongoing litigations, litigations strategy, evidence collection guidance and support to stakeholders, briefing to witnesses.
- Legal Research on issues / challenges faced.
Employment Matters
- Handling Labour/Employment Litigations across India raised under Industrial Disputes Act and other labour laws, succession matters, family dispute matters.
- Advise to internal stakeholders on Policy matters, IR/ER issues, compliance matters related Contract Labour (Regulation & Abolition) Act, Social Security and other benefits administration, Court notices, witness summons etc.
- Discipline Management: Drafting / review of show cause notice, charge-sheet, Termination / Discharge / Dismissal Order under Industrial Employment Standing Order or Service Rules of the Company and other miscellaneous disciplinary documents.
