Role Objective:

The incumbent will manage all legal and litigation matters of SHARQ INSURANCE LLC, including legal claims, court cases, contractual matters, and regulatory compliance obligations. The role is responsible for coordinating with courts, government authorities, external legal counsel, and internal stakeholders to ensure the effective handling and resolution of legal matters, the provision of sound legal advice, and compliance with applicable laws and regulations.


Detailed Roles and Responsibilities:

  1. Review and analyze Police Accident Reports relating to motor claims involving serious traffic violations and determine the Company's legal liability and contractual obligations under the applicable insurance policies and prevailing laws and regulations.
  2. Liaise and coordinate with Police Stations, Traffic Departments, Courts, Public Prosecutors, regulatory authorities, and other relevant government entities regarding all legal matters involving SHARQ Insurance.
  3. Coordinate and follow up with external law firms, and Group Legal (where applicable) concerning: Motor claims involving Third-Party Liability, Death, Bodily Injury, and Property Damage. Non-Motor claims involving Death and Bodily Injury under Workmen's Compensation policies and other insurance covers. Legal disputes or proceedings arising from insurance policies issued by SHARQ. Contractual, commercial, or legal disputes involving SHARQ and its counterparties, customers, service providers, or other stakeholders.
  4. Monitor and manage all ongoing legal matters, litigation, disputes, and claims to ensure their timely progression and resolution while safeguarding the interests of SHARQ Insurance.
  5. Ensure the timely preparation, maintenance, and review of provisioning recommendations for legal claims and litigation matters against SHARQ Insurance, and establish an effective process for periodic reassessment of provisioned amounts based on case developments.
  6. Ensure the effective administration and management of all legal matters, including: Maintaining effective liaison with external legal counsel and law firms. Timely assignment and entrustment of legal matters to external counsel. Maintaining and updating legal notices, summons, and litigation registers. Managing and maintaining valid engagement agreements with external legal service providers. Ensuring adequate representation of the Company before courts, tribunals, and judicial authorities. Maintaining complete, accurate, and systematic records of all legal matters, litigation, contracts, and case files.
  7. Facilitate the prompt resolution, settlement, and disposal of legal cases and disputes in a timely manner to protect the interests of the company.
  8. Coordinate and collaborate with the Compliance, Risk Management, and Internal Audit (Internal Control Function) departments, as required, on matters with legal, regulatory, or risk implications.
  9. Promptly notify the Internal Control Function of any legal matter, dispute, litigation, claim, or regulatory issue that may have a significant financial, operational, regulatory, or reputational impact on SHARQ Insurance.
  10. Review, assess, negotiate, and provide legal advice on contracts, agreements, Memoranda of Understanding (MOUs), service agreements, and other legal documents before the company enters into any contractual relationship, commitment, or transaction.
  11. Identify legal risks associated with business transactions, contracts, insurance operations, and corporate activities, and recommend appropriate risk mitigation measures.
  12. Provide legal guidance and support to management and business units on matters relating to insurance, litigation, contracts, corporate governance, regulatory compliance, and legal risk management.
  13. Conduct transaction monitoring activities to identify unusual, suspicious, or high-risk transactions and ensure appropriate investigation, documentation, escalation, and reporting in accordance with applicable regulatory requirements.
  14. Monitor legal, regulatory, and compliance developments affecting the insurance and financial services sectors and advise management on emerging legal, compliance, regulatory, and reputational risks.
  15. Prepare legal opinions, reports, litigation updates, management summaries, board papers, and other documentation as required by Executive Management.
  16. Develop, implement, maintain, and periodically review the Legal Policies and Procedures Manual to ensure alignment with applicable laws, regulations, and the Company's operational requirements.
  17. Maintain the highest standards of confidentiality, integrity, professionalism, and ethical conduct in the handling of legal, regulatory, compliance, and corporate matters.
  18. Perform any other duties, responsibilities, projects, or special assignments as directed by Executive Management.


Educational Qualifications:

Bachelor's Degree in Law (LL.B.) or an equivalent legal qualification from a recognized university.


Experience:

Minimum of 6 years' experience in legal, claims, litigation, or compliance functions within the insurance industry, with strong knowledge of insurance laws, policy interpretation, and claims-related legal matters.
