POSITION OVERVIEW:
Provide leadership, guidance and counsel to management and leadership regarding Litigation and Risk Management related matters
ESSENTIAL JOB DUTIES/RESPONSIBILITIES:
1. Manage, lead and provide strategic direction to the Litigation and Risk Management teams. Responsible for litigation, liability claims, workers compensation (WC), litigation and risk analytics, insurance, vendor management, claims administration, third party claim administrator performance and process controls
2. Lead, guide, manage and provide legal advice with respect to the defense of the company in response to threatened and/or pending claims, lawsuits, regulatory action, litigation and other legal challenges surrounding third party liability
3. Determine and/or recommend the appropriate course of action in response to actual or threatened litigation, Worker’s Compensation (WC) claims, liability claims and compliance challenges by third parties, including government entities. Plan, direct and supervise the execution of the appropriate course of action
4. Provide legal guidance to other departments and functions in connection with litigation and claims avoidance, legal and regulatory compliance and risk management
5. Provide strategic oversight of the handling and analysis of litigation, WC and liability claims, including liability and damages issues, setting and accuracy of reserves, management of significant settlement authority, evaluation of trends, reporting to insurance carriers and payment of claims
6. Evaluate and approve litigation and claim settlements. Recommend and approve/set claim file reserves in conjunction with Finance. Oversee the creation and adherence to Litigation and Risk budgets and interact with Finance and Senior Executives
7. Oversee management of state regulatory compliance issues involving WC and liability claims, including self-insurance renewals, assessments and bond requirements
8. Protect the Company by mitigating the cost of litigation, WC claims, liability claims and related expenses, while ensuring compliance with related laws and administrative rules and regulations in all states, Canada and Mexico
9. Perform other duties as assigned
