Per Diem Trial Officer

Overview

The New York City Housing Authority ("NYCHA"), the largest public housing authority in North America, is seeking a per diem trial officer to conduct disciplinary trials pursuant to New York Civil Service Law § 75.

As a trial officer, you will:

• Conduct hearings, which will include taking testimony, reviewing transcripts and exhibits, and evaluating witness credibility; applying laws, statutes, policies, and procedures of NYCHA, New York City, and any applicable local, state, and federal laws.
• Prepare and submit Report and Recommendations - which include summary of the evidence, findings of fact, analysis, and a recommendation as to penalty pursuant to Civil Service law § 75, within one month of receipt of a record, for review and decision.
• Ensure that individuals appearing conduct themselves at all times in a dignified, orderly and decorous manner. In particular, at the hearing, all parties, their attorneys or representatives, and observers must address themselves only to the Trial Officer, avoid colloquy and argument among themselves, and cooperate with the orderly conduct of the hearing.
• Ensure that attorneys conduct themselves in accordance with the canons, ethical considerations, and disciplinary rules set forth in the New York State Lawyer's Code of Professional Responsibility in their representation of their clients, in their dealings with the Trial Officer, other parties, attorneys, and representatives.

Compliance with technical rules of evidence is not required and hearsay is permitted, though principles of civil practice and rules of evidence may be applied to ensure an orderly proceeding and a clear record. The standard of proof is preponderance of evidence.

Trial officers are subject to the New York State and City Codes of Judicial Conduct and must maintain the highest standards of ethics. Qualities of judicial demeanor, poise, discretion, patience, tact, and sound judgment are a must.

Minimum Qualifications

• A license to practice law in the State of New York
• Three years of recent satisfactory relevant legal experience subsequent to admission to the bar
• Knowledge of the rules of evidence and procedure as applied to NYS Civil Service Law § 75 Hearings
• Ability to handle complex hearings while producing a professional work product.
• Outstanding writing skills and proficiency in Microsoft Word, Outlook and Teams, and computerized legal research.
