Duties Summary

The Public Utilities Commission regulates all chartered, franchised, certificated, and registered public service companies operating in the State of Hawaii ("State") that provide electricity, telecommunication, gas, private water and sewage, motor and water carrier transportation services and other entities as required by law ("regulated entities"). The Commission has statutory authority to enforce applicable state statutes, and to establish and enforce administrative rules and regulations, and to set policies and standards.

The Office of Commission Counsel is primarily responsible for providing in-house legal counsel to the Commission and its staff; furnishing general legal advisory services in all matters involving the Commission's functions and activities under governing statutes and rules applicable to the Commission; managing Commission orders and Decision and Orders; representing the Commission before reviewing courts, the State legislature, and other State and Federal agencies; and assisting in the formulation of rules and regulations and of legislative matters pertaining to the Commission.

The primary purpose of the position is to serve as Supervisor of the Legal Branch. The duties and responsibilities of the position include assigning and reviewing the work of the staff attorneys, who institute legal action against errant licensees and/or non-licensees regulated by the department’s various boards and commissions.


Minimum Qualification Requirements

Knowledge:
Understanding of general legal principles and statutory and case law.
Skills/Abilities:
Ability to research legal issues and interpret statutes. Good oral and written communication skills. Leadership and managerial experience and aptitude.
Education:
Graduation from an accredited law school with a Juris Doctor degree.
Experience:
Professional Legal Experience:
Must possess at least three and one-half (3-1/2) years of litigation experience which included the preparation of pleadings, motions or other court
documentations and regular court appearances.
Supervisory Aptitude:
Must possess supervisory aptitude, which is the demonstration of aptitude or potential for the performance of supervisory duties through successful
completion of regular or special assignments which involve some supervisory responsibilities or aspects of supervision.
Other:
Must possess a strong propensity for leadership, initiative and managerial ability such as organizational and multi-tasking skills, planning or forecasting for the work needs of the unit, and human-resources/personnel understanding, ability, experience or aptitude.
Must have a deep understanding and respect for unit objectives and operations, including the interplay of unit and unit members with other sections
in the division, as well as unit and unit members’ interactions with the licensing boards and their staff.

This position is exempt from the civil service and considered temporary in nature. Therefore, if you are appointed to the position, your employment will be considered to be "at will," which means that you may be discharged from your employment at the prerogative of your department head or designee at any time.
