Attorney General Andrea Joy Campbell is seeking a highly motivated person to join the Victim Services Division as a Victim Witness Advocate. Members of the Victim Services Division (VSD) are the primary liaisons for victims and witnesses in cases, investigations, and post-conviction federal habeas matters handled by the Attorney General&rsquo;s Office.</p><p>
</p><p>The primary goals of the VSD are: (1) to provide crisis assessment and intervention to crime victims and witnesses; (2) to reduce the level of secondary victimization associated with victims&rsquo; and witnesses&rsquo; involvement in the criminal justice system and other collateral systems; (3) to assist in the investigation and prosecution of crimes by fostering an effective, supportive, and positive relationship with victims and witnesses; and (4) to ensure that crime victims and witnesses are provided with the rights and services mandated by M.G.L. c. 258B. The Victim Witness Advocates (VWA&rsquo;s) aid in investigations, prosecutions, and post-conviction hearings by working closely with victims and witnesses throughout the criminal justice process. VSD works with all the divisions within the Criminal Bureau, as well as other select divisions across the Office.</p><p></p><p>
Primary Duties: The Victim Witness Advocate is responsible for providing information, support, and advocacy services to victims, witnesses, and their families throughout the criminal justice process at the District Court level. The ability to work with victims and witnesses on criminal cases. Duties include, but are not limited to:</p><p>
</p><ul><li> Working with Assistant Attorneys General, investigators, law enforcement partners, support service providers, and Trial Court personnel in the district court to ensure that victims receive rights they are entitled to as established in the Massachusetts Victim Bill of Rights (M.G.L. c. 258B).</li><li> Providing daily in-court support during all hearings and trials. This includes providing daily information, updates, and advocacy services to victims, witnesses, and their families throughout the criminal justice process at the district court level.</li><li> Reading daily ASCISS reports in anticipation of arraignments that may be coming into the district court for the day. Reach out to victims and witnesses prior to arraignments.</li><li>Assisting victims with filling out 209A/258E restraining/harassment order applications and providing in court support through those processes.</li><li>Placing victims on Bail Notification when necessary.</li><li> Providing crisis intervention, safety planning, and support service referrals for victims to other state and community agencies.</li><li> Responding to victim/witness inquiries, assess needs, and determine necessary support resources.</li><li>Coordinating interpreter services for victim and witnesses.</li><li>Providing victims and witnesses with post disposition services such as notification of release, CORI certification, SORB registration, and Probation information.</li><li> Maintaining an assigned caseload, physical case files, and updates in OnBase with victim/witness information.</li><li> Communicating with Superior Court Advocates on cases that will be considered for indictment.</li></ul><p></p><p>

As youth in Massachusetts have a right to jury trials, an Attorney in Charge (AIC) oversees a trial office which integrates the work of Trial Attorneys, a social service advocate (SSA), and an administrative assistant (AA) to fully address the legal and developmental needs of our clients.</div><div></div><div><b><br>
OFFICE OVERVIEW</b></div><div></div><div><br>
Roxbury is one of 23 official neighborhoods of Boston, which states that Roxbury serves as the &quot;heart of Black culture in Boston.&quot; Roxbury was one of the first towns founded in the Massachusetts Bay Colony in 1630. Today Roxbury is home to a diverse community which includes African American, Hispanic, Asian, and White families. The neighborhood has a total population of nearly 60,000 people. The MBTA provides subway and bus services to the Roxbury community. The YAD Roxbury Office is comprised of an AIC, six staff attorneys, a Social Services Advocate, and an Administrative Assistant.</div><div></div><div><b><br>
RESPONSIBILITIES</b></div><div></div><div><br>
Trial Attorneys provide zealous legal representation on delinquency and youthful offender cases using the Positive Youth Development Approach, as well as using all the same criminal defense skills needed to practice in district and superior courts. They also provide post-dispositional advocacy and support to DYS committed youth, as well as school-based advocacy. Trial Attorneys also work on projects related to improving legal representation and outcomes for court involved children. In addition, Trial Attorneys play a leadership role in working towards reducing the racial and ethnic disparities in the juvenile legal system.</div><div></div><div><br>
Trial Attorneys may be assigned cases in other counties as needed.</div><div><br>

A Trial Attorney must be committed to serving a culturally diverse, low-income population and must be eligible to practice law in Massachusetts, either as a member of the Massachusetts bar in good standing, as a law school graduate under Supreme Judicial Court Rule 3:03, or as the member of the bar of another jurisdiction eligible to engage in limited Massachusetts practice under Supreme Judicial Court Rule 3:04;</li><li>
Access to an automobile in order to travel to courts, clients, and investigation locations that are not easily accessible by public transportation; and,</li><li>
Access to home internet access sufficient to work remotely.</li></ul><div><b>

The Committee for Public Counsel Services (CPCS) is the state agency in Massachusetts responsible for providing an attorney when the state or federal constitution or a state statute requires the appointment of an attorney for a person who cannot afford to retain one. The agency provides representation in criminal, delinquency, youthful offender, child welfare, guardianship, mental health, sexually dangerous person, and sex offender registry cases, as well as in appeals and post-conviction and post-judgment proceedings related to those matters.</div>

MENTAL HEALTH LITIGATION DIVISION OVERVIEW</b></div><div><br>
</div><div>The Mental Health Litigation Division provides individuals with attorneys for Civil Commitment proceedings in the District and Superior Courts and provides attorneys for appointment by the Probate and Family Courts to represent persons in Guardianships and Substituted Judgment proceedings, including cases involving Conservatorship, Elder Abuse, the Validation of Health Care Proxies, Nursing Home Admission and Do Not Resuscitate orders. Civil Commitments are handled by both staff and private attorneys, while most cases in the Probate Court are handled by private panel attorneys.</div><div>
In addition to our staff offices in Brockton, Roxbury, Northampton, and Worcester, the MHLD has attorneys in our trial support and oversight office and our training department. All our attorneys receive training in issues relating to mental health and the statutory and constitutional rights of our clients. The Mental Health Litigation Division offers interns a variety of experiences and assignments under the supervision of highly experienced attorneys.</div><div></div><div><br>
Mental Health Commitment Defense Units</div><div></div><div><br>
The MHLD offices located in Brockton, Northampton, Roxbury, and Worcester seeks interns and law coop students who have completed their 2L year and are or can be 3:03 certified to assist attorneys with representation of citizens facing involuntary civil commitment to mental health facilities, and involuntary medical treatment for mental illness, including the administration of anti-psychotic medications. 1Ls are welcome to intern with the commitment defense offices to assist with client calls, reviewing medical records and legal research. Shadow several attorneys during their internship,
</li><li>Develop a working understanding of G.L. c. 123 and the requirements for civil commitment, District and Municipal Court commitment proceedings, court-ordered medication proceedings, and the rules of evidence as applied in mental health cases,</li><li>
Visit clients and conduct interviews to obtain relevant information and ascertain the client&rsquo;s position on their pending petition(s)</li><li>
Work with independent medical experts including psychiatrists, psychologists, social service experts, and other mental health professionals as requested by staff attorneys,</li><li>
Work with attorneys to prepare motions for funds, motions for in person hearings, review medical records, direct examinations, cross-examination of Designated Forensic Psychologists and Psychiatrists and closing arguments,</li><li>
