Position Summary



Manages all general real estate matters, including easements and right of way agreements (transportation, rail bureau, and utility), service line agreements, land assignments, leases (agriculture, mineral, and commercial), property management, acquisitions, disposals, and exchanges of Tribally owned properties including trust lands and fee simple property.

Essential Duties and Responsibilities



  • Develops the Realty Program to ensure that the Tribe’s property interests are protected.
  • Researches, investigates and negotiates purchase of realty property on behalf of the Tribe in accordance with Pueblo of Sandia objectives and priorities.
  • Takes all actions related to residential land assignments in conformity with the rules outlined within the Pueblo of Sandia policies and procedures, including transfers, inheritances, and termination of land assignments.
  • Takes all actions related to agriculture land assignments and leases in conformity with the rules outlined within the Pueblo of Sandia policies and procedures, the Pueblo of Sandia Indian Lands Leasing Regulation and Procedures (Hearth Act of 2012) and The Department of Interior, Bureau of Indian Affairs, 25 CFR Part 162, as applicable, including transfers, inheritances, and termination of farmland assignments and leases.
  • Takes all actions related to the lease of realty property and the granting of licenses, permits, easements of rights-of-way, and service line agreements on Pueblo property and related activities in conformity with the rules outlined within the Pueblo of Sandia Policies and Procedures, Pueblo of Sandia Lands Leasing Regulation and Procedures (Hearth Act of 2012), the Department of Interior, Bureau of Indian Affairs, 25 CFR part 162, and 25 CFR 169, Rights-of-Way on Indian Land.
  • Negotiates leased and purchased property terms and manages the maintenance of collections and auditing of funds of leased property owned by the Tribe.
  • Manages the proper and orderly collection and distribution of lease rentals to ensure the rightful landowner receives lease income.
  • Acts as complaining witness and takes other actions in seeking the prosecution of any persons who trespass on Pueblo property.
  • Accepts and forwards requests for review of Realty Program recommendations according to governing procedure.
  • Processes all documents associated with the purchase of property, including applications to have land placed in trusts, as appropriate.
  • Coordinates acquisitions, disposals, and exchanges of Tribally owned properties including trust lands and fee simple property.
  • Develops and maintains inventory of Tribal lands and all records associated with Tribal property.
  • Provides direction and guidance on the implementation and operation of the Trust Assets Accounting Management System (TAAMS).
  • Works with Tribal departments, federal, state and local officials as appropriate to job duties.
  • Analyzes land development proposals to determine their potential effects on the environment and help determine the need for NEPA compliance.
  • Property management for fee simple lands including but not limited to recruiting potential tenants for rental properties, negotiating, evaluating and enforcing leases, researching and analyzing current values of rental properties, maintenance and inspection of property.
  • Coordinates efforts with federal agencies and consultants to schedule land surveys and soil analysis.
  • Prepares written, verbal and graphic presentations for Tribal Officials.
  • Punctual and regular attendance is an essential responsibility for all team members and are expected to report to work based upon the assigned schedule each day in accordance with the Attendance Policy for Pueblo of Sandia.

This position has Key Performance Indicators (KPI’s) identified as a measurement of success. KPI’s will be shared with all team members who work in this job title and feedback will be provided regarding the successful completion of the KPI’s as part of the performance review process.


Knowledge, Skills, and Abilities


  • Knowledge of the practices and laws governing real estate operations for the Bureau of Indian Affairs to include BIA Manuals, Title 25 Code of Regulations, federal and state laws pertaining to Indian land.
  • Knowledge of the Hearth Act of 2012.
  • Knowledge of real estate conveyances (deeds, easements), contractual relationships (leases and permits), land descriptions, title status reports, and abstracts of title and condemnations.
  • Knowledge of general real estate values, land development trends, and methods of real estate financing and leasing.
  • Ability to manage projects, establish timelines, and exercise self-management.
  • Knowledge of federal, state, local, private and foundation grants and financing processes, procedures, mechanisms and applications.
  • Knowledge of the function of appraisals and its effect on real estate values.
  • Knowledge of property value analysis and property taxes.
  • General knowledge of federal environmental compliance laws and processes under NEPA, Clean Water Act, and Endangered Species Act.
  • Ability to establish, collect, organize and maintain databases, files, and archives.
  • Knowledge of property management.
  • Ability to deal effectively and professionally with the public.
  • Ability to effectively communicate in writing and verbally.
  • Ability to analyze, evaluate and apply the information contained in real estate reports to market, rental, and easement appraisals in presentations in various formats and capacities.
  • Ability to read and interpret; plats, legal descriptions, land surveys, GIS maps, soil analysis, warranty deeds, land titles and topographical maps.
  • Proficient in Windows and Microsoft Office suite.
  • Ability to work harmoniously and professionally with co-workers and supervisors.


Education and Experience


Required:

  • High School Diploma, GED certification or equivalent.
  • Bachelor’s Degree in Business Administration.
  • Three (3) years’ experience related to essential functions specified.

Note: Any combination of education from an accredited college or university in a related field and/or direct experience in this occupation totaling seven (7) years may substitute for the required education and experience.



License/Certifications/Registrations


  • Must possess and maintain a valid, unrestricted New Mexico driver’s license.
  • Must be able to successfully pass a stringent background investigation and character investigation in compliance with PL 101.630.
  • Will require a pre-employment and random drug screening.

List Working Conditions Required:


  • Work is performed indoors and outdoors. Outside work is subject to temperature extremes and inclement weather conditions.
  • Work hours subject to change with overtime work required.
  • Subject to hazards which may cause personal bodily harm; smoke; diseases; cuts bruises, burns, common cold, influenza, dust, odors and elevated noise levels.
  • Tasks may be performed on uneven, inclined, hard and soft carpeted floors, cement structures and surfaces.
