About the Job:
The Operations Counsel, Associate General Counsel (“AGC”), under the guidance and supervision of the Chief Legal Officer, provides legal advice and services related to the facility operations of Summit BHC (together with its affiliates and operating facilities, the “Company”). The services include providing legal support to all aspects of operations, including advising on healthcare regulatory matters, including those relating to fraud and abuse, referral source agreements and healthcare compliance, drafting and negotiating contracts, supporting the development team in acquisitions and development of new facilities and expansions to existing facilities, and licensure matters. The AGC will protect the legal interests of the Company and ensure compliance with the law.Roles and Responsibilities:
Analyze legal and regulatory requirements and provide guidance to the Company in all aspects of healthcare operations.
Negotiate, draft, and review contracts and other legal documents, including agreements with physicians and physician groups, payor and vendor agreements, purchasing agreements, joint venture agreements, licenses and other IT agreements.
Collaborate with stakeholders to ensure that the contractual relationships among the Company and its vendors, suppliers, contractors and providers are consistent with the Company’s strategic goals and objectives, and comply with applicable laws, regulations and ethical standards.
Serve as a member of a high performing team; build and maintain exceptional employee morale and motivation; and foster an exceptional culture and workplace.
Collaborate with others in Legal and Compliance to develop, update and implement policies, procedures and programs.
Actively contribute to the organization through development and implementation of industry-leading best practices to build departmental capabilities, processes and functions.

Partner with and influence others to identify, manage, and mitigate legal and regulatory risks in operational areas, and provides creative and well-informed solutions.
Identify and meet unmet needs (i.e., gaps and process failures) and be energized by rising to new challenges.
Ensure that consistent and standard advice is provided across the group with respect to all matters; and
Provide clear and practical legal advice.
Leadership Functions:
Identifies and prioritizes issues of importance, including those priority issues as set for by leadership. Collaborates with department leaders and corporate executive leaders, as needed.
Communicates instructions, expectations and timelines clearly and concisely.
Manages staff scheduling to maintain productivity levels, curtailing unnecessary overtime and/or excessive staff work hours.
Maintains accountability expectations for self and staff in all areas of job performance.
Engages staff in quality and safety basics to ensure sustained, measurable compliance.
Identifies staff educational needs and ensures they are addressed with education programs that are attended by staff.
Hold staff accountable for non-compliance and safety concerns, as well as attendance, following policies, behavior, and adherence to the code of conduct.
Education/Experience/Skill Requirements:
Juris Doctorate (J.D.) required.
One or more years of supervisory experience required.
Active license to practice law per state requirement required.
Seven or more years of relevant health care-related legal experience in a law firm and/or healthcare organization that includes advising on healthcare laws and regulations, such as those relating to privacy, fraud, waste and abuse, physician self-referral and anti-kickback, EMTALA, and regulations applicable to Medicare, Medicaid, and other government programs required.
Experience with one or more of the following areas: employment matters and litigation, corporate transactions, governance, payor arrangements and disputes, patient issues, privacy, and other areas of the law relevant to healthcare organizations.
