The</b><b> </b><b>Consumer Protection Division</b><b> </b><b>of the Washington State Attorney General&rsquo;s Office is seeking to hire attorneys to join its team as an Assistant Attorney General (AAG). The CP Division aims to protect Washington consumers from unfair and deceptive acts through its enforcement of the Consumer Protection Act (CPA), RCW 19.86, and other consumer protection laws.</b></div><div><b><br>
The position will be located in downtown Seattle or Spokane, WA, depending on the needs and interest of the person hired to fill this role. The AGO provides some flexibility with respect to schedules and telecommuting, consistent with the needs of the Office.</b></div></div><p></p>

<p></p><div><div><b>As a CP attorney, you will get the opportunity to serve some of Washington&rsquo;s most vulnerable communities. While the CP Division&rsquo;s work is for the benefit of all Washington consumers, much of the Division&rsquo;s enforcement actions are focused on unlawful business practices that target people of limited means, veterans, the elderly, and immigrants. In this position, you would be at the forefront of these cases, and your work will have a direct, measurable impact on the lives of vulnerable Washingtonians.</b></div><div></div><div><b><br>
The Division&rsquo;s management strives to find engaging, interesting, and fulfilling work that is well suited to the experience level and interests of the individual AAGs. The Division does a good job of balancing the staffing needs of the various investigations and cases with the interests of AAGs in particular subjects and industries. There are AAGs in the Division who choose to focus on specific areas, like healthcare, veterans&rsquo; issues, or privacy matters, while others prefer a variety of practice areas. The Division&rsquo;s management also makes professional growth a priority. If you are offered this position, you can expect to have a great deal of responsibility for and control over your daily work while also working with teams of attorneys who complement and cover for each other. As an experienced AAG you will lead your own investigations and all aspects of civil litigation, including discovery, motions practices, and resolving cases through trial or negotiated settlements. More senior AAGs are expected to provide mentorship and leadership to newer attorneys and staff. You will be expected to manage your caseload to ensure matters are moving expeditiously. You may also be required to advise the Attorney General&rsquo;s leadership and policy staff on consumer protection issues and provide public education and outreach.</b></div><div></div><div><br>
Attorneys can expect to participate in high-profile consumer protection litigation such as State v. Navient (student lending), State v. Providence (charity care violations), State v. The</b> <b>Complex Litigation Division</b> <b>at the Washington State Attorney General&rsquo;s Office </b><b>has an opportunity for an experienced attorney interested in litigating significant issues that face our State and the nation. This position will be located in downtown Seattle or Olympia depending on the needs and interests of the person hired to fill this role.</b></p></div><p></p>
<div><h2 class="jobSectionHeader"><b>Duties</b></h2></div>
<p></p><div><div>Attorneys in the Complex Litigation Division work on some of the Office&rsquo;s most challenging and high-profile cases. The Division has many ongoing cases challenging overreach by the federal government, including recent lawsuit on HUD homelessness grants, public benefits programs, student mental health grants, gender-affirming care, FEMA disaster mitigation funding, the dismantling of HHS, teen reproductive health education, and public health grants. The Division has a lengthy history of challenging past federal government action including leading multistate litigation to protect and increase access to medication abortion. The Division will remain at the forefront of the fight to protect Washingtonians&rsquo; reproductive rights.</div><div></div><div><br>
The Division also litigates cases such as Washington&rsquo;s lawsuits related to the opioid epidemic; challenges to the constitutionality of the State&rsquo;s law restricting gun magazine capacity size and the law banning the sale of assault weapons; a campaign finance enforcement action; challenges to the State&rsquo;s forest management and conservation plans; and ongoing arbitrations related to the Tobacco Master Settlement Agreement.</div><div></div><div><b><br>
Duties of attorneys in the Complex Litigation Division include directing and assisting in investigations; drafting pleadings, motions, and memoranda from initial filing through post-judgment proceedings; depositions and all other aspects of discovery; presenting oral argument; and participating in trial and post-trial proceedings, including appeals, in state and/or federal court. The Division collaborates with many of the Office&rsquo;s divisions, including the Solicitor General&rsquo;s Office, on the cases it litigates. Organization
<br><br>
The Civil Rights Division is primarily responsible for enforcing federal statutes, constitutional provisions, and executive orders that prohibit, among other things, unlawful discrimination in education, employment, housing, police services, public accommodations and facilities, voting, and federally funded and conducted programs. The laws that the Division enforces also prohibit conduct by law enforcement agencies, as well as conditions of public residential institutions, such as health care and correctional facilities, that violate the constitution.
<br><br>
As the Deputy Assistant Attorney General (DAAG), the successful candidate:
<br><br>
Serves as consultant and advisor on all matters of major policies requiring the personal attention of the Assistant Attorney General (AAG).
<br>Reviews and supervises the work of one or more CRT sections and meets regularly with section managers to communicate the enforcement and policy priorities of the AAG and to ensure that each section's work aligns with those priorities.
<br>Advises on and decides questions of policy and procedure arising in connection with the initiation, conduct, and termination of civil rights litigation, both civil and criminal, subject to review by the AAG.
<br>Confers with, advises, and instructs senior members of CRT, special counsel, and other Division and Department attorneys on matters relating to the enforcement of statutes, constitutional provisions, executive orders, and other regulations assigned to CRT.
<br><br>
The DAAG Is expected to conceive and formulate policies and programs for elimination of unlawful practices of discrimination involving federally protected civil rights, anticipating, minimizing, or obviating wherever possible apparent federal and state conflicts with respect to enforcement of civil rights. In emergencies, conducts field surveys and inspection trips to troublesome areas in civil rights matters for the purpose of advising and aiding the AAG in the formulation of departmental policy and determining when the Department must take prosecutory or other corrective action.

Drafts, reviews, and comments on the Department's legislative program on civil rights, with a view to determining their adequacy under the Constitution and the need of such legislation in the enforcement of federally protected civil rights.

Confers with individuals and groups who call upon the Department in connection with civil rights matters, advises such individuals and groups thereon, and initiates appropriate action.

The position involves significant legal writing responsibilities, including preparation of internal memoranda, briefs for trial courts and the courts of appeals, and other court filings. Appellate AUSAs will participate in moot courts and handle oral arguments before the appellate courts. Appellate AUSAs may also assist in trial-level litigation in cases of unusual complexity or importance.

</p><div><b>POSITION SUMMARY:</b><br>
This position performs general and legal administrative support work to assist the Prosecuting Attorney&rsquo; s Office by independently gathering and maintaining files and maintaining communication to other parties for efficient handling of cases; and provides courteous and efficient customer service to the public.<br>
<br>
<b>ESSENTIAL FUNCTIONS:</b><br>
<i>The following duties are essential for this position. However, they are not to be construed as exclusive or all&ndash;inclusive. To be successful in this position, an individual must be able to perform each duty satisfactorily. Other duties may also be required or assigned.</i><br>
<ul><li> Provides first line customer service to internal and external customers; greets, receives and screens visitors and customers; receives calls on a multi-line phone system and routes calls to appropriate individual or takes messages.</li><li> Addresses and resolves customer questions/concerns as able and refers complex inquiries, requests, or complaints to appropriate staff.</li><li> Establishes, maintains and updates detailed files, records, dockets, and logs on computerized and manual recordkeeping systems; verifies data, then enters and edits reports or information; searches files and records for readily identifiable information as directed; monitors inactive files, updates records and destroys as authorized.
</li><li> Types and distributes legal documents, forms, briefs, correspondence, reports, memoranda, dispositions, statistics and schedules from hand written drafts or notes, verbal or standing instructions by using computers, calculators, photocopier, scanner, Microsoft Office, and other standard office equipment.
</li><li> Enters case information into proper system, performing basic research to ensure correct parties are listed in case file and ensuring proper court dates are entered into case calendar.</li><li> Obtains media and case reports, entering them in the correct case file, sending media and case files to appropriate law enforcement agencies/attorneys.</li><li> Maintains an appointment and court calendar for staff in assigned area and may assist in scheduling of appointments, meetings, and hearings.
</li><li> Responds to public records requests.</li><li> Sets-up, maintains, and updates accurate and complete case files and records making required docket entries; prepares case files for court sessions, processing and/or assuring inclusion of all necessary legal documents as ordered by the court; monitors inactive files and destroys as authorized.
</li><li> Sorts, copies, and distributes a variety of correspondence, deliveries, and time-stamps mail; opens, logs, and routes office mail; may prepare out-going mail for the department including bulk and special mailings.</li><li> Composes general correspondence and prepares regularly recurring reports; types and distributes standardizes forms; proofreads and edits documents.</li><li> Enters, scans, indexes, updates, and maintains information in spreadsheets, databases, and reports.</li><li> Maintains electronic filing, paper filing, and record systems to provide easy access to records and information; provides retention of records as required by Office and County policies.</li><li> Organizes and maintains resource information in a variety of formats.</li><li> Performs basic skip tracing duties and conducts interviews to obtain necessary location information, as assigned.</li><li> Assists other department personnel during peak period of work or for absences.</li><li> Other duties as assigned.</li></ul>
