Under the direction of the Executive Agency Attorney, with latitude for independent judgment and unreviewed action and decision, the selected candidate will have duties which include, but are not limited to:

<ul><li>Assist Agency personnel with legal aspects of areas of responsibility and resolve day to day Agency issues.</li><li>Advise the Chief of Laboratories, the General Counsel, and other Executive Staff regarding legal issues concerning the OCME laboratories.</li><li>Assist and supervise highly technical litigation discovery responses for OCME laboratories.</li><li>Assist in compliance with subpoenas and court orders served upon the Agency.</li><li>Assist with the review and processing of Freedom of Information Act requests.</li><li>Assist in the conduct of internal investigations and advise human resources on employment related matters affecting agency workforce.</li><li>Resolve legal issues involving forensic analysis in OCME laboratories, quality assurance, laboratory protocols, and the retention of forensic samples.
</li><li>Coordinate Agency response regarding legal compliance of CODIS and LDIS DNA Database.</li><li>Draft, review, and edit Non-Disclosure Agreements, Data Sharing Agreements, and Beta Testing pertaining to OCME laboratories, as well as contract specifications for specialized laboratory services.</li><li>Enhance an agency-wide witness training program for staff, including employees of the labs and forensic pathology.</li><li>Review all research projects, surveillance studies, and human subject research submissions involving the Agency.</li><li>Coordinate as needed with DOHMH Institutional Review Board.</li><li>Review and analyze local, state, and federal law and legislative recommendations and proposals related to forensic science and subject matters which may impact the Agency.</li><li>As needed, assist with resolution of dispute cases where intervention by the Legal Department is necessary.
</li><li>Communicate with next of kin, otherwise authorized persons, attorneys, and/or estate administrators, as necessary, in communicating Agency requirements in resolving dispute cases.</li><li>Assist with coordinating Agency actions related to paternity requests, tissue specimen hold requests, and release of tissue specimens.</li><li>As needed, coordinate Agency outreach to the City&rsquo;s Conflict of Interest Board.</li><li>Assist with Agency actions regarding regulation and management of DNA sample collection consent forms for OCME and non-OCME personnel.</li><li>Perform other duties as assigned</li></ul><br>

POSITION OVERVIEW
</b></p><p>Reporting to the General Counsel, the Assistant General Counsel (&ldquo;AGC&rdquo;) is responsible for drafting and negotiating commercial contracts. In addition, the AGC works closely with the real estate acquisition division as new real estate projects are developed. The AGC supports research into the crafting of policies and procedures that impact the entire agency and provides advice on regulatory matters. We work collaboratively and value diverse opinions.</p>

MAJOR DUTIES AND RESPONSIBILITIES</b></p>
<ul>
<li>Draft and negotiate commercial contracts with vendors and outside counsel using a contract management software system known as MyDocks.</li>
<li>Review leases and purchase and sale agreements interpreting applicable provisions to ensure compliance with terms and conditions.</li>
<li>Reviewing and responding to agency requests for advice and counsel.</li>
<li>Participate on internal real estate committee tracking project developments.</li>

<li>Ensure that all contracts have current insurance requirements. Oversee paralegal to support insurance related work.</li>

Court Administration, Office of

The duties that the incumbent of the vacancy will be expected to perform. Duties Description This position is situated in the Office of Court Administration (OCA) Counsel’s Office. Duties include, but are not limited to: (1) Assisting with all trial and appellate litigation conducted by Counsel’s Office, including litigation in federal and state court and before federal and state agencies involving Unified Court System (UCS) policies, practices and personnel. (2) Analyzing complex legal issues and questions presented by proposed administrative rules and legislation. (3) Handling employee disciplinary matters, responses to subpoenas, freedom of information requests, and related matters. (4) Hands-on litigation work including court and other hearing appearances.(5) Serving as a liaison with the NYS Office of the Attorney General in litigation matters. (6) Undertaking other work as assigned. Assistant Deputy Counsel specialize in particular substantive areas of the law whichrelate to the development and implementation of court policies and the administration of the Unified Court System (UCS). They are responsible for assisting less experienced attorneys in Counsel's Office under the general direction of OCA Counsel and Deputy Counsel. Assistant Deputy Counsel analyze complex legal issues and questions presented by proposed administrative rules, legislation, and litigation, advise judges and non-judicial personnel on the implications of procedures and programs, and perform other related duties.BASE SALARY: $130,061* + $4,920 LOCATION PAY*Note: Pursuant to the New York State Office of the State Comptroller Salary Manual for the Unified Court System, candidates from other branches of NYS government may be appointed at a salary above the $130,061 base salary, up to a maximum of $168,568, based on their current grade and length of prior NYS service.

The minimum qualifications required for this vacancy. Minimum Qualifications Admission to the New York State Bar and five (5) years of legal experience. Candidates with substantial litigation experience (including court and administrative proceedings) are encouraged to apply.Candidates should have substantial experience handling and overseeing litigation, strong written and oral skills, and excellent interpersonal skills.
