POSITION OVERVIEW</b></p><p>
Sanctuary for Families Community Law Project (CLP) seeks an attorney with domestic violence and/or family law experience to provide comprehensive, culturally competent legal services to survivors of domestic and gender based violence who seek assistance with family offense, custody/visitation, and child/spousal support proceedings, as well as matrimonial matters. The attorney will also conduct community legal clinics, outreach and training and will collaborate with other agencies to advocate for systemic change. The attorney will work out of the Manhattan Office and will report to the Center&rsquo;s Sr. Deputy Director and Sr. Director.</p><p></p><p><b><br>
RESPONSIBILITIES</b></p><ul><li>
Provides direct representation and advocacy to clients in family law litigation, including family offense, custody and visitation, child and spousal support and divorces in all five boroughs of NYC. Provides other advocacy as needed, including the criminal legal and child protective systems;</li><li>
Provides pro se legal assistance and consultations to clients in family law matters;</li><li>
Conducts legal clinics at community based organizations;</li><li>
Staffs the Legal Helpline;</li><li>
Co-counsels cases with project, Legal Center and <i>pro bono </i>attorneys; supports training of junior staff members.Advocates directly for clients with key stakeholders including but not limited to NYPD, prosecutors, Administration for Children&rsquo;s Services (ACS), Human Resources Administration (HRA), and Division for Homeless Services (DHS);</li><li>
Conducts community based outreach and training;</li><li>
Works with Sanctuary&rsquo;s Community and Outreach Training Initiative (SCOTI) to coordinate, organize and participate in outreach and training events;</li><li>
Represents Sanctuary for Families on task forces and other political and advocacy committees outside the agency.</li><li>
Collaborates with volunteers, interns and <i>pro bono</i> attorneys.</li><li>
Directs cases to the appropriate resources within the agency and the Legal Center;</li><li>
Tracks the status of cases referred internally and externally;</li><li>

<p><b>ABOUT US</b></p><p>The Center for Appellate Litigation (CAL) is a leading holistic legal services organization dedicated to providing high-quality appellate representation to low-income New Yorkers. CAL is assigned to represent New Yorkers convicted of crimes in Manhattan and the Bronx in their criminal appeals and other post-conviction proceedings. We pride ourselves on adopting dynamic approaches to serve our clients and challenge the status quo. Outside of the courtroom, we work tirelessly to protect our clients&rsquo; well-being through an array of client support service projects, including the Conditions of Confinement Project (&ldquo;Conditions Project&rdquo;). Our team of dedicated attorneys, paralegals, and staff work tirelessly to advocate for our clients' rights and uphold the principles of justice.</p><p><b>POSITION OVERVIEW</b></p><p>CAL is seeking to hire an attorney to supervise our Conditions Project and advocate for clients experiencing confinement-related issues. The attorney will oversee our Conditions Project Client Advocates (&ldquo;CAs&rdquo;) in their work advocating for clients incarcerated in New York State prisons who are facing issues related to excessive use of force and harassment by DOCCS staff, denial of medical and mental health treatment, harassment and violence by fellow inmates, access to counsel issues, and violations of HALT. In addition to supervising the Conditions CAs, the attorney will represent clients at Tier III disciplinary hearings and work with clients to assist them in understanding sentence computations, obtaining jail-time credits through re-sentencings and negotiations, and obtaining violent- felony-override certificates. NYLAG is seeking a highly motivated attorney within NYLAG&rsquo;s Immigrant Protection Unit to provide legal representation to immigrant survivors of sexual and gender-based violence, intimate partnerviolence, and other trauma. The job requires substantive knowledge and experience working with trauma survivors in seeking DV-related immigration relief, removal defense, and asylum. The staff attorney must be able to manage urgent matters efficiently and independently while maintaining a trauma-informed and client-centered approach. The staff attorney will represent immigrants in administrative and removal proceedings before U.S. Citizenship and Immigration Services (USCIS) and the Immigration Courts.<br>
<b>Duties and Responsibilities

The staff attorney&rsquo;s responsibilities will include:<br>

The Neighborhood Defender Service of Harlem (NDS) is a community-based, client-centered, holistic public defense office headquartered in Harlem, providing the highest quality legal representation in criminal, civil, immigration and family courts to residents of Northern Manhattan and the Bronx who cannot afford to hire a lawyer. NDS is seeking lateral staff attorney candidates and law graduate candidates to start as soon as possible.</div><div></div><div><br>
The Family Defense Practice at NDS represents parents in family policing cases (sometimes called &ldquo;child welfare&rdquo; or &ldquo;child protection&rdquo; cases) filed by the Administration for Children&rsquo;s Services (ACS) as well as related family court cases, including custody, visitation and termination of parental rights proceedings in Manhattan and The Bronx. Through our holistic approach to representation, the Family Defense Practice provides parents with the help they need&mdash;both inside and outside of court&mdash;to keep their families safe and stable. NDS is committed to advancing due process rights for parents by fighting unwarranted state intervention in their lives and advocating for related systemic change. The Staff Attorney or Law Graduate will work closely with attorney and social work supervisors, litigation assistants, team administrators, client advocates and social workers to provide vigorous representation to clients in Article 10, Termination of Parental Rights, Custody and other related cases.</div>
Responsibilities:
<ul><li>Provide excellent representation with energy, enthusiasm and a commitment to striving for client-centered holistic advocacy throughout the case;</li><li>
Take primary responsibility, with appropriate supervisory support, of all aspects of Article 10 and related custody, visitation, guardianship, paternity, termination of parental rights and other cases including client counseling, motion practice, discovery, oral argument, settlement negotiations, and hearings and trials;</li><li>
Meet frequently in-person with clients to prepare for court proceedings;</li></ul><ul><li>
Collaborate and meet regularly with social workers, client advocates, litigation assistants and other attorneys to strategize case strategy and prepare and coordinate in- and out- of court advocacy to secure optimal outcomes on behalf of clients;</li><li>
Engage in frequent in-person and virtual court hearings and litigation, often on an emergency basis;</li><li>
Engage in formal and informal advocacy with opposing counsel and attorney(s) for children;</li><li>
Staff intake in court regularly, as assigned;</li><li>
File motions, briefs and other related court papers on a frequent, timely basis;</li><li>
Provide effective oral advocacy in negotiation and argument in Family Court;</li><li>
Be responsive to and communicate clearly with clients who are often under great stress;</li><li>
Work under high pressure in an atmosphere of frequent emergencies and tight deadlines;</li><li>
Maintain thorough and accurate records and client files by timely saving documents in NDS&rsquo;s cloud server and entering notes and other data into NDS&rsquo;s case management system;</li><li>
Collaborate with and provide mentorship to less experienced staff attorneys when appropriate and commensurate with experience; and</li><li>
Must be able to work a minimum of 14 plus hours a week in person in the Harlem or Bronx offices (as per borough assignment), court satellite offices, or in court, and more as needed in support of providing excellent representation.</li></ul><br>

Qualifications:<br>

J.D. degree and admission to practice law in New York State or eligible for admission;</li><li>
Demonstrated commitment to parents&rsquo; rights, indigent defense, social justice issues and/or the Harlem communities;</li><li>
Must be very flexible and possess a high level of organizational and administrative skills in order to manage a high caseload;</li><li>
Must possess excellent written and oral communication skills;</li><li>
Must be able to work cooperatively with NDS colleagues and opposing counsel, and problem-solve independently;</li><li>
Candidates with experience representing parents in Article 10 Abuse and Neglect proceedings or equivalent experience providing defense/direct representation are strongly encouraged to apply;</li><li>
Lived experience with the Family Policing System and other systems impacting NDS&rsquo;s clients preferred, and</li><li>

COMPENSATION</b></div><div>
Compensation is commensurate with experience and is in adherence to the NDS compensation scale. For this position, the salary range for attorneys with 0-36 years of directly relevant experience is <b>$82,693 - $173,110</b>.</div><div></div><div><br>
Full medical and dental benefits, as well as other benefits, are provided. The salary, benefits, and employment policies relevant to this position are governed by the CBA between NDS and the NDS Union, part of ALAA UAW 2325.</div><div></div><div><b><br>

Position Objective:</b></p><p>
The Labor Counsel is responsible for providing expert legal advice on Labor Relations matters to MTA senior staff and managers. This role represents the authority in disciplinary cases and trials, determines the strategy for litigation, and serves as an advocate in administrative proceedings for the MTA and its agencies.</p><p><b>
Responsibilities:</b></p><ul><li>
Arbitrations and Administrative Tribunals. Serve as the authority&rsquo;s legal advocate in contract grievances, disciplinary cases, arbitrations, trials, mediations, and administrative proceedings, ensuring that the Authority&rsquo;s position is effectively presented.</li><li>
Formulates litigation strategy and settlements, prepares witnesses, gathers evidence, researches legal issues, drafts legal briefs and other litigation papers, presents oral arguments to arbitrators, mediators, and Administrative Law Judges.</li><li>
Serve as counsel to Authority management, providing day-to-day advice and legal evaluation in connection with disciplinary matters, labor issues, New York State Civil Service Law, contract interpretations, and policy formation.</li><li>
Ensure compliance with the legal obligations required under the collective bargaining agreements as well as under New York State and Federal law.</li><li>
Review labor legislation and formulate the Authority&rsquo;s statement in support/statement in opposition to legislation. Ensure the Authority&rsquo;s position on proposed legislation is delivered timely to the MTA&rsquo;s legislative team.</li><li>
Evaluate evidence, assess possible litigation outcomes, draft disciplinary charges, formulate proposals, day-to-day contact and negotiations with union representatives to resolve litigation matters, and respond to information requests / FOIL requests for information sought by labor.</li><li>
Participate in collective bargaining negotiations, record minutes of collective bargaining negotiations, assist in developing collective bargaining strategies, and ensure the smooth implementation of collectively bargained terms. Negotiate labor contracts within cost guidelines and patterns set by the MTA.</li><li>
Participate in Labor/Management meetings. Prepare minutes from prior Labor/Management meetings. Address and resolve issues without the need for grievances or litigation, and maintain a channel of effective communication with the unions.</li><li>

Required Qualifications:</b></div><br>

With wide latitude for the exercise of independent judgment, decision making and initiative, this position involves presenting the Authority&rsquo;s position in litigated proceedings as well as in day to day incidents involving disciplinary matters; advocating to judges, arbitrators, mediators, unions and senior level management that certain actions are necessary for the operational needs of the Authority and/or the resolution of disputes; proposing strategies to ensure the appropriate resolution of disputes that is consistent with law and the Authority&rsquo;s goals and policies.</li><li>
Preparation of litigation strategy and evidence.</li><li>
Presentation of evidence at arbitrations, administrative proceedings, and disciplinary conferences and trials.</li><li>
Knowledge of the statutory framework of labor relations in New York, including knowledge of New York State Civil Service Law, Administrative Law, and Taylor Law.</li><li>
Knowledge of OATH practice, arbitration, and labor administrative tribunals and their practices.</li><li>
Prioritize the heavy workload and demands of the Labor Relations department as well, to present cases to further the goals of the Authority.</li><li>
The position requires a strong legal advocate while maintaining a balanced approach to labor management issues.</li></ul><div></div><div><b><br>
Required Education and Experience:</b></div><br>

J.D. degree from an accredited Law School is required.</li><li>
Admitted to practice law in the State of New York is required.</li><li>
