<p>The New York City Housing Authority (&ldquo;NYCHA&rdquo;) Law Department Administrative Hearings Division (&ldquo;AHED&rdquo;) conducts administrative termination of tenancy proceedings brought on such grounds as non-desirability, including violence against NYCHA employees, breach of NYCHA rules and regulations, illegal assignment or transfer of possession of an apartment, and misrepresentation.</p><p>AHED also represents NYCHA in remaining family member and rent grievances brought by public housing residents and Section 8 participants. Attorneys in this Division shall, with wide latitude for making independent decisions for a high volume of cases, draft charges, negotiate settlements and litigate via in person or remote appearances termination of tenancy and subsidy matters before an Impartial Hearing Officer on the following grounds: Non-Desirability, Breach of Rules and Regulations, Chronic Delinquency in the Payment of Rent, Non-Verifiable Income, Assignment or Transfer of Possession and Misrepresentation. The attorney is also responsible for representing NYCHA at hearings with regard to various Tenant Grievances, Remaining Family Member Grievance Claims and Section 8 cases. This is done to ensure that these cases are handled expeditiously and in accordance with all legal requirements set forth in the Escalera Consent Decree, Williams Consent Decree and all other laws pertaining to tenant litigation.</p><p><b>Responsibilities of the Agency Attorney will include, but are not limited to the following:</b></p><ul><li>Quickly identify key issues in a case and gain a rapid resolution with a minimum of supervision and with wide latitude for independent judgment.</li><li>Prepare and litigate administrative hearings and grievances including preparing charges, requesting investigations, negotiating settlements, and appearing at Hearings to represent NYCHA.</li><li>Prepare and argue difficult cases involving significant precedents in administrative tribunals and in the courts.</li><li>Answer routine inquiries from managers, opposing counsel and Borough management on assigned cases.</li><li>Conduct legal research on complex cases and prepare memoranda.</li><li>Draft complex, highly technical rules or regulations.</li><li>Maintain computer records in the Case Management System and prepare memos and other documents regarding case dispositions.</li><li>Maintain all case files, evidence and computer files for large caseload. TIHSD handles most legal issues relating to property tax exemptions and abatements, Mitchell Lama developments, Redevelopment Companies, and rent regulation.<br>

As an Executive Agency Counsel, you will be a senior legal advisor for the Agency in support of HPD's property tax exemptions and abatements.<br>

Your Role:<br>

You will perform complex legal work in the areas under TIHSD&rsquo;s jurisdiction. You may act as a liaison with the Law Department on important administrative law litigation affecting HPD programs and participate in drafting legislation and rules, holding public hearings, attending high-level meetings regarding Agency policy, and reviewing proposed City and State legislation. You will report to the Deputy General Counsel for TIHSD.<br>

The Executive Agency Counsel&rsquo;s responsibilities may include but not be limited to:<br>

Perform difficult and complex legal work related to tax incentives and housing supervision with significant financial, procedural and policy consequences, with a particular focus on litigation assistance related to tax incentives compliance enforcement and real property tax benefit application denials. Analyze federal, state and local statutes and regulations. Draft and/or review proposed state and local legislation and regulations as well as litigation papers prepared by the New York City Law Department. Counsel senior agency staff. Handle other complex legal issues.<br>
